Terms of Service

Welcome to StudyDork ("the App"), operated by StudyDork Team ("we", "us", or "our"). By downloading, installing, or using the App you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

We may update these Terms from time to time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms. We will notify you of material changes through in-app notifications or email.

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms of Service.

2. Eligibility

You must be at least 13 years of age to create an account and use the App. If you are between 13 and 18 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly collect personal information from children under 13.

3. Account Registration & Security

You may sign in using email one-time passcode (OTP), Google Sign-In, Microsoft Sign-In, or Apple Sign-In. You are limited to one account and are responsible for all activity under your account. You must provide accurate information and keep your credentials secure.

You may delete your account at any time through the App's settings. Account deletion permanently removes all server-side data associated with your account. Locally cached data on your device will remain until the App is uninstalled.

4. Description of the Service

StudyDork is a productivity and focus management app designed for students. The App provides the following features:

• Calendar Integration: Connect your Google Calendar, Microsoft Outlook, or Apple Calendar to view events and schedule study sessions.
• Screen Time Lockout: Voluntarily block selected apps on your device during focus sessions using iOS FamilyControls or ManagedSettings, or Android overlay and foreground services where applicable.
• Pose-Based Unlock: Use your device camera and on-device pose detection through Google ML Kit to perform physical exercises, such as squats and T-poses, as an unlock mechanism.
• Gamification: Earn dork points, maintain streaks, and compete with friends on leaderboards. Early quitting a session incurs a points penalty and has no financial consequences.

5. Physical Activity Disclaimer

The App includes features that require you to perform physical exercises, such as squats and T-poses, to unlock your device or complete sessions. By using these features, you acknowledge and agree to the following:

• Use at Your Own Risk: You are solely responsible for assessing your own physical fitness and ability before engaging in any exercise prompted by the App. You assume full responsibility for any injuries, discomfort, or health issues that may result from performing these exercises.
• Consult a Professional: If you have any pre-existing medical conditions, physical limitations, injuries, or health concerns, you should consult a qualified medical professional before using the exercise-based features of the App.
• No Medical Advice: The App does not provide medical, fitness, or health advice. The exercises included are for gamification and screen-time management purposes only and are not designed as a fitness programme.
• Safe Environment: You are responsible for ensuring you perform any exercises in a safe environment with adequate space and stable footing.

Nothing in these Terms excludes or limits our liability for damages arising from injury to life, body, or health caused by our wilful misconduct or gross negligence, as required by applicable law.

6. Device Permissions

The App may request the following device permissions:

• Camera: Used solely for on-device pose detection during exercise-based unlock verification. Camera data is processed locally and is never transmitted to any server.
• Calendar: Read and write access to display your events and create study sessions.
• Screen Time / Family Controls (iOS): To block selected apps during lockout sessions.
• Notifications: To send alerts for auto-lock triggers and session completion.

You may revoke any permission at any time through your device settings, though doing so may limit certain App features.

7. Screen Time & App Blocking

The App's lockout feature uses iOS FamilyControls and ManagedSettings frameworks, and Android overlay or foreground services where applicable, to restrict access to apps you voluntarily select. You acknowledge and agree that:

• You are solely responsible for choosing which apps to block and the duration of lockout sessions.
• Early quitting a session results only in a gamification penalty, being the loss of dork points, and not any financial charge.
• We are not liable for any consequences arising from your inability to access blocked apps during a lockout session, including missed communications or emergency situations.
• You should ensure critical communication apps remain accessible during lockout sessions.

8. In-App Purchases

The App may offer optional in-app purchases or subscriptions in the future, managed through the Apple App Store or Google Play Store. If and when such features become available:

• All purchases are processed by the respective app store platform and are subject to that platform's terms and refund policies.
• Subscriptions will automatically renew unless cancelled before the end of the current billing period. You may manage or cancel subscriptions through your device's app store settings.
• We reserve the right to modify pricing or subscription tiers with reasonable notice. Existing subscribers will be notified of any changes before their next billing cycle.
• Refunds are handled by the applicable app store in accordance with its policies.

9. User Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable law.
• Attempt to reverse-engineer, decompile, or disassemble the App or its underlying systems.
• Interfere with or disrupt the App's servers, networks, or infrastructure.
• Create multiple accounts or impersonate another person.
• Exploit the gamification system through automated means, bots, or other manipulation.
• Circumvent, bypass, or tamper with the screen time lockout or app blocking features.

Display Name Policy

When creating or updating your display name, you must choose a name that is appropriate and respectful. The following types of display names are strictly prohibited:

• Names that are offensive, vulgar, profane, or sexually explicit.
• Names that promote or contain hate speech, discrimination, or harassment based on race, ethnicity, nationality, religion, gender, gender identity, sexual orientation, disability, or any other protected characteristic.
• Names that impersonate other individuals, public figures, or organisations.
• Names that promote violence, illegal activity, or self-harm.

We reserve the right to reset any display name that violates this policy without prior notice. Repeated or severe violations may result in account suspension or termination.

10. Third-Party Services

The App integrates with third-party services to provide its features. Your use of these services is subject to their respective terms and privacy policies:

• Supabase: Authentication and database services.
• Google Calendar API: Access to your Google Calendar data, subject to the Google API Services User Data Policy, including the Limited Use requirements.
• Microsoft Graph API: Access to your Outlook calendar data.
• Apple Calendar: Device-level calendar access via the device_calendar framework.
• Google ML Kit: On-device pose detection. All processing occurs locally on your device and no data is sent to Google.

We are not responsible for the availability, accuracy, or practices of third-party services.

11. Intellectual Property

All content, features, design, code, and branding in the App are owned by StudyDork Team and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes.

12. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We do not guarantee that the App will be uninterrupted, error-free, or secure. We do not warrant the accuracy of any calendar synchronisation or pose detection features.

13. Limitation of Liability

Subject to mandatory provisions of applicable law:

• We are liable for damages caused by wilful misconduct or gross negligence, and for injury to life, body, or health.
• TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STUDYDORK TEAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR INABILITY TO ACCESS BLOCKED APPS DURING LOCKOUT SESSIONS, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

14. Indemnification

You agree to indemnify and hold harmless StudyDork Team, its affiliates, and their respective officers, directors, and employees from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

15. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. You may terminate your account at any time by using the account deletion feature within the App.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
