Terms of Service

Welcome to StudyDork ("the App"), operated by StudyDork Team ("we", "us", or "our"). By downloading, installing, or using the App you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

We may update these Terms from time to time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms. We will notify you of material changes through in-app notifications or email.

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms of Service.

2. Eligibility

You must be at least 13 years of age to create an account and use the App. If you are between 13 and 18 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly collect personal information from children under 13.

3. Account Registration & Security

You may sign in using an email one-time passcode (OTP), Google Sign-In, or Apple Sign-In. Connecting a Microsoft Outlook calendar is a separate step and is not a way to sign in. You are limited to one account and are responsible for all activity under your account. You must provide accurate information and keep your credentials secure.

You may delete your account at any time through the App's settings. Account deletion permanently removes the server-side data associated with your account, subject to the limited exceptions set out in our Privacy Policy. Locally cached data on your device will remain until the App is uninstalled.

4. Description of the Service

StudyDork is a productivity and focus management app designed for students. The App provides the following features:

  • Focus Sessions: Start timed study sessions, track focus minutes, and review your session history and per-subject statistics.
  • Calendar Integration: Connect your Google Calendar, Microsoft Outlook, or Apple Calendar to view your events and plan study sessions around them. The App reads your calendars; it does not create, change, or delete events in them.
  • Screen Time Lockout: Voluntarily block apps you select during focus sessions. On iOS this uses Apple's Screen Time frameworks (FamilyControls and ManagedSettings). On Android it uses an accessibility service, a foreground service, and a screen overlay, which you must grant separately.
  • Sleep Mode: Set a nightly schedule during which selected apps are blocked, and review a record of your nights.
  • Unlock Actions: Complete an action to end a lockout early. The available actions are a simple tap, or a camera-based exercise using on-device pose detection: squats, push-ups, or a T-pose hold. You choose which action applies to you.
  • Gamification: Earn XP, level up, maintain streaks, complete daily challenges, and compete in weekly leagues. Ending a session early costs XP and may require you to complete an unlock action first. Neither has any financial consequence.
  • Social Features: Add friends, compare standings on leaderboards, and join or create clans. Chat is available inside a clan or a study room. There are no direct messages.
  • Study Rooms: Decorate a personal study room, choose whether it is private, visible to friends, or open to everyone, visit other users' rooms, and leave ratings and reviews.
  • Store and Cosmetics: Spend gems on cosmetic items, and open chests containing randomised cosmetic content.
  • Pro Subscription: An optional paid subscription that unlocks additional features and removes advertising.
  • Widgets and Live Activities: Display your streak and current session on your home screen and Lock Screen.
  • Sharing: Share a streak image or a clan invitation to other apps on your device.

Features may be added, changed, or removed over time. Nothing in these Terms guarantees the continued availability of any particular feature.

4.1 Simulated Accounts

Not every account in the App belongs to another student. Some are simulated accounts operated by us. They exist so that leagues, leaderboards, clans, and room discovery still work when too few real users are active at a given moment - for example in a new region, at a quiet hour, or in the App's early days.

  • Simulated accounts may appear on leaderboards and in leagues, may belong to clans, and may host study rooms you can visit and review.
  • Their focus sessions, points, streaks, and comings and goings are generated by us. They are not the activity of real people, and you should not treat them as such.
  • Competing against a simulated account does not change what you earn. Points, gems, chests, and league rewards are calculated the same way either way.
  • We may add, change, or remove simulated accounts at any time, and may adjust how they behave.

We do not use simulated accounts to send you messages pretending to be a real user, to solicit purchases, or to induce you to buy anything.

5. Physical Activity Disclaimer

The App includes features that require you to perform physical exercises - squats, push-ups, or holding a T-pose - to unlock your device or end a session. If you have chosen an exercise as your unlock action, ending a session early can require you to complete it before the block lifts. By using these features, you acknowledge and agree to the following:

  • Use at Your Own Risk: You are solely responsible for assessing your own physical fitness and ability before engaging in any exercise prompted by the App. You assume full responsibility for any injuries, discomfort, or health issues that may result from performing these exercises.
  • Consult a Professional: If you have any pre-existing medical conditions, physical limitations, injuries, or health concerns, you should consult a qualified medical professional before using the exercise-based features of the App.
  • No Medical Advice: The App does not provide medical, fitness, or health advice. The exercises included are for gamification and screen-time management purposes only and are not designed as a fitness programme.
  • Safe Environment: You are responsible for ensuring you perform any exercises in a safe environment with adequate space and stable footing.

Nothing in these Terms excludes or limits our liability for damages arising from injury to life, body, or health caused by our wilful misconduct or gross negligence, as required by applicable law.

6. Sleep Mode Disclaimer

Sleep Mode blocks selected apps on a schedule you choose. It is a screen-time tool, not a health, medical, or sleep-tracking service. The App does not measure your sleep, does not read from Apple Health, Google Fit, or any similar service, and any sleep score it shows reflects only your use of the App. Do not rely on it for any health purpose.

7. Device Permissions

The App may request the following device permissions:

  • Camera: Used solely for on-device pose detection during exercise-based unlock verification. Camera data is processed locally and is never transmitted to any server.
  • Calendar: To read your events so the App can show your schedule and plan sessions around it. Google's consent screen may ask you to grant broader calendar access than this; the App only reads.
  • Screen Time / Family Controls (iOS): To block selected apps during lockout and Sleep Mode sessions.
  • Accessibility service, display over other apps, and usage access (Android): To detect when a blocked app is opened and to show the blocking screen. The App also reads the list of apps installed on your device so you can choose which to block. This information stays on your device.
  • Notifications: To send alerts for auto-lock triggers, session completion, social activity, and other notifications you have enabled.
  • Tracking (iOS): Optional. Declining means the advertising shown to you is non-personalised. See section 11.

You may revoke any permission at any time through your device settings, though doing so may limit certain App features.

8. Screen Time & App Blocking

The App's lockout feature uses iOS FamilyControls and ManagedSettings frameworks, and Android overlay or foreground services where applicable, to restrict access to apps you voluntarily select. You acknowledge and agree that:

  • You are solely responsible for choosing which apps to block and the duration of lockout and Sleep Mode sessions.
  • Ending a session early costs XP and may require you to complete your chosen unlock action first. Neither is a financial charge.
  • We are not liable for any consequences arising from your inability to access blocked apps during a lockout session, including missed communications or emergency situations.
  • You should ensure critical communication apps remain accessible during lockout and Sleep Mode sessions.

9. Community Features & User Content

The App includes social features: friends, clans, chat inside a clan or study room, public study rooms, and room reviews. Content you submit through these features - including your display name, clan name, tag and description, chat messages and reactions, room reviews, and your room layout - is referred to here as "User Content".

9.1 Your Responsibility

You are solely responsible for your User Content. You must not submit User Content that:

  • Is unlawful, or promotes or facilitates unlawful activity.
  • Is offensive, vulgar, profane, sexually explicit, or otherwise inappropriate.
  • Constitutes hate speech, harassment, bullying, threats, or discrimination based on race, ethnicity, nationality, religion, gender, gender identity, sexual orientation, disability, or any other protected characteristic.
  • Promotes violence, self-harm, or dangerous behaviour.
  • Impersonates another person, public figure, or organisation.
  • Infringes the intellectual property, privacy, or other rights of any person.
  • Is spam, advertising, a scam, a solicitation, or an attempt to obtain another user's personal information or account credentials.

9.2 Licence to Us

You retain ownership of your User Content. By submitting it, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute that content solely for the purpose of operating and improving the App. This licence ends when the content is deleted, except for copies retained as described in our Privacy Policy and for content already shared with other users.

9.3 Moderation

We apply automated filtering to display names and other user-submitted text. Automated filtering is not perfect, and we do not pre-screen all User Content. We may, but are not obliged to, review, remove, or restrict any User Content and may reset any display name, clan name, or clan description that violates these Terms, in each case without prior notice. Repeated or severe violations may result in account suspension or termination.

9.4 Blocking and Reporting

You can block other users and report users, reviews, and other content from within the App. Blocking is mutual: a blocked user cannot contact you, and you cannot contact them. If you host a study room, you may also remove a guest from your room or ban them from rejoining it. We review reports as we consider appropriate but do not guarantee any particular outcome or response time.

9.5 Content from Other Users

User Content is created by other users, not by us. We do not endorse it and are not responsible for it. You may encounter content you find objectionable. If you do, please block the user or report the content.

10. In-App Purchases, Subscriptions, Gems, and Chests

10.1 Purchases and Subscriptions

The App offers optional in-app purchases and subscriptions, sold through the Apple App Store or Google Play Store and managed on our side by a subscription management provider.

  • All purchases are processed by the respective app store platform and are subject to that platform's terms and refund policies. We do not receive or handle your payment details.
  • The Pro subscription automatically renews at the end of each billing period unless cancelled at least 24 hours before the period ends. You may manage or cancel a subscription at any time through your device's app store settings. Cancelling stops future renewals; it does not refund the current period.
  • Pro unlocks additional features and removes advertising. The specific features included in Pro may change over time as the App evolves.
  • We reserve the right to modify pricing or subscription tiers with reasonable notice. Existing subscribers will be notified of any changes before their next billing cycle.
  • Refunds are handled by the applicable app store in accordance with its policies.
  • Purchases are tied to your StudyDork account and to the app store account used to buy them. You can restore purchases on a new device using the same app store account.
  • If you are under the age of 18, you may only make a purchase with the permission of the holder of the payment method used.

10.2 Gems

Gems are the App's virtual currency. They may be purchased with real money or earned through ordinary use of the App.

  • Gems are a limited, personal, non-transferable, revocable licence to use a feature of the App. You do not own them, and they are not your property.
  • Gems have no monetary value. They cannot be redeemed for money, refunded for cash, or exchanged for anything of value outside the App.
  • Gems cannot be sold, gifted, traded, or transferred between accounts, and may not be bought or sold through any third party.
  • Purchased gems are consumable and are delivered to your account once the purchase is confirmed. Delivery may take a short time while the purchase is verified.
  • Unspent gems are forfeited if your account is deleted or terminated, except where a refund is required by applicable law.
  • We may add, remove, re-price, or retire items purchasable with gems at any time.

10.3 Chests and Randomised Items

Some items in the App are supplied through chests, which contain randomised cosmetic content.

  • The chance of receiving each rarity of item is disclosed inside the App, on the chest itself, before any purchase is made. You can view these odds at any time from the Store without buying anything.
  • Each chest is rolled independently. Previous results do not change the chance of any future result, except where the App explicitly states a guarantee - for example a slot guaranteed to contain an item of a stated rarity or better.
  • Where a chest would grant an item you already own, it is converted into gems at a rate shown in the App. This is compensation for a duplicate, not a separate reward.
  • Chest contents, odds, and prices may be adjusted over time. The odds shown in the App always reflect those currently in force.
  • Chests obtained through ordinary use of the App - for example through streaks, daily challenges, level ups, or leagues - are not purchases and have no monetary value.
  • Chests and their contents cannot be exchanged for money, real-world goods, or anything of real-world value, and no prize of real-world value is offered at any point.

10.4 Cosmetic Items

Items obtained with gems or from chests are cosmetic. They do not confer any competitive advantage, have no monetary value, cannot be transferred between accounts, and are licensed to you on the same terms as gems. We may retire, alter, or replace cosmetic items at any time.

11. Advertising

The App shows rewarded advertising only. We do not show banner or interstitial ads, and you will never be shown an ad you did not choose to start. Each rewarded ad is offered in exchange for an in-app reward, and watching one is always optional.

  • Ads are supplied by Google and by other advertising networks competing through mediation. We do not control the content of individual ads and are not responsible for it.
  • Rewards are granted only once the ad has been watched to the point required by the ad network. If an ad fails to load or is closed early, no reward is granted.
  • Ad availability is not guaranteed. We are not liable for any reward you were unable to claim because no ad was available.
  • Users with an active Pro subscription are not shown ads.
  • On iOS you may decline app tracking, in which case the ads shown to you are non-personalised. On Android you may reset your Advertising ID or opt out of ad personalisation in your device settings.

12. User Conduct

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable law.
  • Attempt to reverse-engineer, decompile, or disassemble the App or its underlying systems.
  • Interfere with or disrupt the App's servers, networks, or infrastructure.
  • Create multiple accounts or impersonate another person.
  • Exploit the gamification system through automated means, scripts, emulators, modified clients, or other manipulation, including falsifying focus sessions, XP, streaks, league standings, or pose detection.
  • Attempt to obtain gems, chests, cosmetic items, Pro access, or rewarded-ad rewards other than through the means the App provides, or exploit any bug or error to do so.
  • Circumvent, bypass, or tamper with the screen time lockout or app blocking features.
  • Harass, abuse, threaten, or spam other users through chat, clans, study rooms, or reviews.
  • Submit false or manipulated room reviews, or coordinate with others to inflate or suppress ratings.
  • Access, scrape, or collect other users' data, or attempt to interact with our servers other than through the App.

We may reverse any points, gems, items, or standings obtained in breach of this section, and may suspend or terminate accounts involved.

13. Third-Party Services

Some features depend on services you connect and authorise yourself. Your use of them is governed by their own terms:

  • Google Calendar, read subject to the Google API Services User Data Policy, including the Limited Use requirements.
  • Microsoft Outlook calendar.
  • Apple Calendar on your device.
  • The Apple App Store or Google Play Store, which processes any purchase you make.

Behind the App we also use providers for cloud hosting, push notifications, subscription management, advertising, analytics, and feedback delivery. Our Privacy Policy describes what each receives, and we will name our current providers on request.

Pose detection runs entirely on your device using the machine learning built into iOS and Android. No camera or pose data is sent to any server.

We are not responsible for the availability, accuracy, or practices of third-party services.

14. Intellectual Property

All content, features, design, code, and branding in the App are owned by StudyDork Team and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes. This section does not affect your ownership of your User Content, which is governed by section 9.

15. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We do not guarantee that the App will be uninterrupted, error-free, or secure. We do not warrant the accuracy of any calendar synchronisation, pose detection, sleep score, or focus statistics, nor the availability of any social feature, study room, or advertisement.

16. Limitation of Liability

Subject to mandatory provisions of applicable law:

  • We are liable for damages caused by wilful misconduct or gross negligence, and for injury to life, body, or health.
  • TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STUDYDORK TEAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF VIRTUAL ITEMS OR GEMS, THE CONDUCT OR CONTENT OF OTHER USERS, OR INABILITY TO ACCESS BLOCKED APPS DURING LOCKOUT SESSIONS, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

17. Indemnification

You agree to indemnify and hold harmless StudyDork Team, its affiliates, and their respective officers, directors, and employees from any claims, damages, losses, or expenses arising from your use of the App, your User Content, or your violation of these Terms.

18. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately, and any unspent gems, cosmetic items, and unopened chests are forfeited, except where a refund is required by applicable law. You may terminate your account at any time by using the account deletion feature within the App.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia. Nothing in these Terms limits any non-excludable rights you have under the Australian Consumer Law or other mandatory consumer protection law in your jurisdiction.
